Cyphe Danzae Radio ("the Platform") is an independent artist broadcasting platform designed exclusively to empower independent musicians, creators, and content producers to launch and operate their own internet radio stations.

The Platform is built for independent artists who own full rights to the content they broadcast. Major artists and record labels are also welcome, provided they operate in full compliance with all applicable copyright laws and licensing requirements.

Cyphe Danzae Radio is NOT a music streaming service for third-party copyrighted content. It is a broadcast infrastructure platform. The distinction is critical: you are the broadcaster, and you are responsible for what you broadcast.

As a station operator on Cyphe Danzae Radio, you represent and warrant that: (a) you own all rights to the content you broadcast, or (b) you have obtained all necessary licenses, permissions, and authorizations from the applicable rights holders prior to broadcasting.

Required licenses may include, but are not limited to: performance rights organization (PRO) licenses (ASCAP, BMI, SESAC), SoundExchange digital performance royalties for sound recordings, synchronization licenses where applicable, and any other licenses required under applicable law.

You agree to indemnify, defend, and hold harmless Cyphe Danzae Radio, its owners, officers, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your broadcast of content that infringes any third-party intellectual property rights.

Cyphe Danzae Radio reserves the right to remove any content, suspend, or terminate any station found to be in violation of copyright law or these terms, with or without prior notice.

Major artists and record labels are welcome on Cyphe Danzae Radio, provided they operate in full compliance with all applicable laws and platform terms.

Major label content, signed artist recordings, and commercially released music may only be broadcast by parties who hold the appropriate digital performance and broadcast licenses for such content.

Cyphe Danzae Radio does not enter into licensing agreements on behalf of station operators with major labels, publishers, or performance rights organizations. All licensing arrangements are the sole responsibility of the station operator.

Cyphe Danzae Radio complies with the Digital Millennium Copyright Act (DMCA). If you believe content broadcast on our platform infringes your copyright, you may submit a takedown notice to our designated DMCA agent.

Upon receipt of a valid DMCA takedown notice, we will act expeditiously to remove or disable access to the allegedly infringing content and notify the station operator.

Station operators who receive a takedown notice may submit a counter-notification if they believe the content was removed in error. Repeat infringers will have their accounts terminated.

DMCA notices and counter-notifications must meet the requirements set forth in 17 U.S.C. § 512. Please contact us through our support channels to submit a DMCA notice.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYPHE DANZAE RADIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO: (A) ANY CONTENT BROADCAST BY STATION OPERATORS; (B) ANY COPYRIGHT INFRINGEMENT BY STATION OPERATORS; (C) ANY THIRD-PARTY CLAIMS ARISING FROM CONTENT BROADCAST ON THE PLATFORM.

Cyphe Danzae Radio's total liability to any party for any claim arising out of or related to these terms or the platform shall not exceed the amount paid by you to Cyphe Danzae Radio in the twelve (12) months preceding the claim.

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if Cyphe Danzae Radio has been advised of the possibility of such damages.

Cyphe Danzae Radio collects only the information necessary to operate the platform — including account registration details (name, email address), payment information processed securely through Stripe, and usage data such as tracks uploaded and station activity.

We do not sell, rent, or share your personal information with third parties for marketing purposes. Your data is used solely to provide and improve the platform, process payments, and communicate service-related updates.

We use industry-standard security measures to protect your data. You may request deletion of your account and associated data at any time by contacting us through our support channels.

By using Cyphe Danzae Radio, you consent to the collection and use of information as described in this policy. This policy may be updated periodically — continued use of the platform constitutes acceptance of any changes.

By creating an account or using Cyphe Danzae Radio, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

You must be at least 18 years old to create a station or paid account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Cyphe Danzae Radio reserves the right to modify, suspend, or discontinue any part of the platform at any time. We may update these terms at any time — continued use of the platform after changes constitutes acceptance.

These terms are governed by the laws of the United States. Any disputes arising from these terms or your use of the platform shall be resolved through binding arbitration in accordance with applicable law.
